Freedom of Information
The Freedom of Information Act 1982 (FOI Act) gives the public a right to access information held by the Australian Naval Nuclear Power Safety Regulator.
The FOI Act gives any person the right to:
- access copies of documents (except exempt documents) we hold;
- ask for information we hold about you to be changed or annotated if it is incomplete, out of date, incorrect or misleading; and/or
- seek a review of our decision not to allow you access to a document or not to amend your personal record.
Exemptions may relate to national security, material obtained in confidence, Cabinet documents, or other matters set out in the FOI Act.
The FOI Act also requires an agency to publish information on its operations under the Information Publication Scheme and a disclosure log of information that has been accessed under FOI requests.
A FOI applicant may find the information they are seeking is already available in those publications.
Freedom of Information Requests
Applications for access to documents must:
- be in writing;
- state that the application is made under the Freedom of Information Act 1982 (the FOI Act);
- provide enough information concerning the documents sought as is reasonably necessary to enable a responsible officer of the department to identify them; and
- give details of how notices may be sent to the applicant (for example, a postal or email address).

The Australian Naval Nuclear Power Safety Regulator will send a letter explaining the decision within 30 days, unless otherwise notified. The 30 day period may be extended when:
- the requestor agrees to the extension of time;
- the request captures a large amount of information; or
- there is a requirement to consult third parties.
Information might be redacted, or denied in full, where it is exempt from release under the FOI Act.
Acknowledgement of a FOI request will be sent within 14 days. An estimate of any fees will be provided before the request is processed.

Where the requestor is not satisfied with the decision, they have the right to request a review.
- Internal review - must be requested via email to foireview@annpsr.gov.au within 30 days of receipt of the decision.
- External review - will be completed by the Office of the Australian Information Commissioner and must be requested within 60 days of receipt the decision.
